How to Immigrate to USA Without Sponsorship or a Job Offer

Basically, to immigrate to the United States, you need to either marry a U.S. citizen, win the DV lottery green card, or get a sponsorship from an employer.

However, there is a little-known non-immigration method to the United States that allows you to move to the United States and relocate/immigrate without a job offer, visa sponsorship, or employment contract. This is called the EB-1 visa for aliens of extraordinary ability.

What is the EB-1 Visa?

The EB-1 visa is a green card category for aliens who have demonstrated extraordinary ability in the sciences, arts, education, business, or athletics.

The EB-1 visa is a highly competitive category, but it is one of the few green card categories that does not require a job offer or visa sponsorship.

Who Qualifies for the EB-1 Visa?

To qualify for the EB-1 visa, you must meet at least three of the following ten criteria:

  6. Authorship of scholarly articles in professional or major trade publications or other major media
  7. Artistic exhibitions or showcases
  8. Performance of a leading or critical role in distinguished organizations
  9. Command of a high salary or other significantly higher remuneration in relation to others in your field
  10. Commercial successes in the performing arts

How to Apply for the EB-1 Visa

To apply for the EB-1 visa, you must file Form I-140, Petition for Alien Worker. The filing fee is $700. You can pay the fee with a money order, personal check, cashier’s check, or credit card.

Processing Time

With premium processing, USCIS is required to adjudicate a case within 15 days of receiving the petition.

Immigrating with Your Family

If your I-140 petition is approved, your spouse and unmarried children under the age of 21 may be eligible to apply for admission to the United States in E-14 or E-15 immigration status, respectively.
